    Transfer of Property Act The Transfer of Property Act is an Indian legislation which regulates the transfer of property in India. It contains specific provisions regarding what constitutes transfer and the conditions attached to it. According to the Act, 'transfer of property' means an act by which a person conveys property to one or more persons, or himself and one or more other persons. Section 7 of the Transfer of Property Act, provides that every person competent to contract i.e. a major and of sound mind or is not disqualified by law for contracting. Therefore even the interest of a co-owner or co-sharer can be sold, mortgaged, leased to another co-sharer or to a stranger.

    The law relating to transfer of property is governed by the Transfer of Property Act, Before this Act came into force there was practically no law as to real property in India.
